Termination of Parental Rights

Parents, children and courts can terminate a parent-child relationship, but only a court can legally terminate a parent’s parental rights. The most common reasons for involuntary termination include severe or chronic abuse, abandonment, long-term mental illness or deficiency of the parent(s), and failure to support or maintain contact with the child, among many other reasons. FAQ

My spouse and I are divorcing. We agree to share joint physical custody of our minor child. Does that mean neither of us pays child support to the other?

You both have an obligation to support your child, regardless of the custody order. In Nevada, joint custodians each owe the other parent-child support. The normal support formula is applied to both your incomes, and the parent with the higher income pays the difference to the other parent.

My husband died, and I found a bank account in his name with $10,000 in it. I am not on the account, and there is no beneficiary. Do I have to go to court?

You may well be able to get the money through the use of a special affidavit that includes several statements, including that your spouse’s probate estate is worth less than $100,000.00 and that you are entitled to the money under the laws of succession. If you can honestly complete that affidavit, you can present it to the bank holding the account. They will more than likely release the money to you. No court required.

My sister left her three-year-old with me two years ago, and I haven’t seen her since. I don’t know who her father is. She is ready to begin kindergarten, but I have no way to enroll her in school. What do I do?

You should consider filing a petition for guardianship of your niece. A guardianship would give you the legal authority to take actions for your niece’s benefit, such as enrolling her in school. Or, if you want to adopt, you could file a petition to terminate your niece’s parents’ parental rights. If successful, your niece should then be free for adoption, in which case you might be promoted from Auntie to Mommy!
