Probate

Probate is a legal process in which a deceased person’s estate is distributed to their heirs and designated beneficiaries. Along with this, any outstanding debts owed to creditors are paid if resources exist. Probate property is distributed according to the decedent’s valid will, or according to state intestacy law if no will is found. On average, it takes anywhere from six to nine months to complete a simple probate case, with some taking years if there are disputes. Proper estate planning may help avoid this lengthy and costly legal process.

My husband died, and I found a bank account in his name with $10,000 in it. I am not on the account, and there is no beneficiary. Do I have to go to court?

You may well be able to get the money through the use of a special affidavit that includes several statements, including that your spouse’s probate estate is worth less than $100,000.00 and that you are entitled to the money under the laws of succession. If you can honestly complete that affidavit, you can present it to the bank holding the account. They will more than likely release the money to you. No court required.
